These Terms and Conditions of Use (hereinafter referred to as “Terms”) govern access to and use of the websites https://sayseeshow.com and https://sayseeshow.io/app, as well as the mobile and web applications provided by S.A.S. Say See Show (hereinafter referred to as the “Provider”).

By accessing, downloading, installing, or using the websites or the applications, you acknowledge having read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, do not use the services.

ARTICLE 2: ACCESS TO SERVICES

The websites and applications provide free access to the following services:

  • Online help and documentation
  • FAQ sections
  • Access to the Say See Show app with limited free services
  • Optional purchase of licenses to unlock additional features

Access requires an internet connection. The user is solely responsible for the costs incurred (hardware, software, network).

ARTICLE 3: ACCEPTANCE OF THE END USER LICENSE AGREEMENT (EULA)

Before using the Say See Show application, users must accept the End User License Agreement (EULA). Refusal of the EULA blocks the use of the application. This applies both to the web version (https://sayseeshow.io/app) and to the mobile versions available via Google Play Store and Apple App Store.

ARTICLE 4: INTELLECTUAL PROPERTY

All content present on the websites and applications—texts, logos, brands, images, sound, videos, software, interface design, structure, and source code—are the exclusive property of S.A.S. Say See Show or are used under license.

  • The trademarks “Say See Show!” and “C’est si chaud” are registered by the Provider.
  • Any reproduction, representation, adaptation, distribution, modification, or exploitation, in whole or in part, without prior written authorization, is strictly prohibited and may result in legal action.
  • In accordance with Article L122-5 of the French Intellectual Property Code, citations must include the name of the author and the source.

ARTICLE 5: PERSONAL DATA AND PRIVACY

Personal data is processed in accordance with the Privacy Policy, accessible at: https://sayseeshow.com/privacy/

The Provider complies with all applicable data protection regulations, including:

  • GDPR (EU)
  • LPRPDE (Canada)
  • CCPA & COPPA (California, USA)
  • BDSG & TTDSG (Germany)
  • LPD (Switzerland)
  • LSC (Vietnam)

The Provider collects only limited information during license acquisition and initial application use. No personal account is required.

ARTICLE 6: COOKIE POLICY

No cookies or behavioral advertising trackers are used on the websites or application. Therefore, consent banners are not required.

ARTICLE 7: PAYMENT AND LICENSE PURCHASE

The application is free with limited access. Users may purchase a license to unlock advanced features. Payment is made online and is non-refundable in accordance with EU law on digital content (software license).

ARTICLE 8: LIMITATION OF LIABILITY

The websites and application are provided “as is.” The Provider makes every effort to ensure accurate and up-to-date information but does not guarantee the absence of errors or omissions.

The Provider shall not be liable for:

  • Damages due to misuse or incompatibility
  • Indirect or consequential losses
  • Security incidents not attributable to proven negligence
  • Third-party content accessible via hyperlinks

ARTICLE 9: SECURITY AND AVAILABILITY

Data is hosted in Switzerland and France by Infomaniak. Security measures include HTTPS encryption, secure storage, and anonymization of statistical data after 2 years.

ARTICLE 10: USER OBLIGATIONS

The user agrees to:

  • Use the services lawfully
  • Not attempt to bypass security or license restrictions
  • Not misuse the websites or application for fraudulent purposes

ARTICLE 11: APPLICABLE LAW AND JURISDICTION

These Terms are governed by the laws of France. In the absence of amicable resolution, disputes will be submitted to the competent courts in France.

ARTICLE 12: MODIFICATIONS TO TERMS

The Provider reserves the right to update these Terms. Users will be notified via the website or application. Continued use constitutes acceptance of the revised Terms.
