1. Preamble
These General Terms and Conditions of Sale (“GTCS”) govern exclusively the sale of usage licenses for the SAY SEE SHOW mobile application, whether through the website https://sayseeshow.io/app or directly via the application.
By accessing the Application and purchasing a license, the user acknowledges having read, understood, and unreservedly accepted these GTCS, as well as the Terms of Use ( https://sayseeshow.com/gtc/ ), the Privacy Policy ( https://sayseeshow.com/privacy/ ), and the Legal Notice ( https://sayseeshow.com/legal-notices/ ).

3. Nature of the Product
SAY SEE SHOW is a digital application that transforms an old smartphone into a monitoring system for personal belongings or an abnormal motion detection device, including falls, for non-medical surveillance purposes.
It is a consumer-grade software product and does not fall under the regulatory framework applicable to medical devices (see Terms of Use).
4. Business Model – Freemium License
The application follows a freemium model. Some features are accessible free of charge. Full access to all advanced features requires the purchase of an annual license, valid for one (1) year from the purchase date.

No automatic renewal: The license does not renew automatically.

Device-bound validity: The license is tied to the device on which it is purchased.

Non-transferability: The license cannot be transferred to another device.
5. Pricing and Payment
Prices are listed in the country currency or by default in euros (€), including all applicable taxes (VAT).
Payment is made exclusively via the methods offered in the application. Currently, transactions are processed through the Revolut platform.
A proof of purchase is generated at the end of the transaction and may be retained by the user.
6. License Delivery
The license is delivered immediately after payment, directly to the device used for the purchase, via a certified file stored locally (in the browser or application cache).
SAY SEE SHOW strongly recommends purchasing the license from the primary device (the one that will receive alerts), not from the older smartphone (which acts as a sensor). No post-purchase license transfer is possible.
7. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content provided without physical support, the performance of which has begun after the consumer’s prior express consent.
By confirming the purchase, the user expressly waives their right of withdrawal.
8. Warranty and Service Availability
SAY SEE SHOW commits to providing a service consistent with the description provided in the application and on the website.
In the event of a malfunction not caused by improper use, the user may contact technical support via the online form available on the website.
The publisher does not guarantee complete continuity or error-free operation, particularly in cases of network failure, OS updates, or hardware compatibility issues.
9. Liability
The publisher declines all liability for use of the application for medical or equivalent purposes, in accordance with the medical device exclusion clause stated in the Terms of Use.
The user remains solely responsible for configuring, installing, and interpreting any data output from the application.
10. Personal Data Protection
The handling of personal data collected during the purchase process is governed by the official Privacy Policy: https://sayseeshow.com/privacy/.
The data collected is strictly limited to order processing and is not shared with third parties.
In accordance with the GDPR, users have the right to access, rectify, delete, restrict, or object to the processing of their data, as well as the right to data portability.
11. Dispute Resolution and Governing Law
In the event of a dispute, an amicable resolution will always be sought first.
These GTCS are governed by French law.
In case of legal proceedings, jurisdiction is granted to the courts in the district of the head office of S.A.S. Say See Show, unless otherwise required by mandatory law.
12. Version and Modifications of the GTCS
The version of the GTCS applicable is the one in effect at the time of purchase. S.A.S. Say See Show reserves the right to modify these GTCS at any time. Users will be informed of any material changes via the website or the application.
